The Trial of Khloe Thompson
It was supposed to be a simple case. Hell, it shouldn’t have even been a case, but Judge Salinger threw out the plea deal. Instead of a couple years of probation and loss of license for the rest of her life, the case went to trial as a first and second degree murder charge. A jury trial for a simple hit-and-run turned into a shitstorm with a plot straight out of a Lifetime movie.
We all thought it started on the night of April 25th when the news broke of an SUV driven by a young woman jumped the curb and hit a bunch of frat brothers partying outside of Crow’s house, Alpha Kappa Rho. 4 bros were playing cornhole out on the yard and a few more were milling about when the Beemer refused to stop until it hit the frat house. 7 guys were hit by the car and a few more got hurt when the living room caved in. 2 guys died on the scene and 3 more later that night in the hospital. Everyone assumed drunk driving, but she blew a 0.00 BAC. Drug tests showed she was cleaner than a whistle. At first she claimed that she lost control of the vehicle because she blacked out, but nothing in her system suggested a likely cause. MRI at the hospital didn’t show any proof of a seizure or anything. Cops were baffled for a motive.
The young woman was Khloe Thompson. She came from a modest upbringing. Parents weren’t poor, but they weren’t rich either. Khloe just finished her freshman year of college studying business management. She was maybe 5’3” with a phat ass and a small chest, and her dark hair and complexion belied a Latin background.
Khloe hadn’t ever had so much as a detention in high school, let alone a criminal record. So everything at the time pointed to an accident. Since it looks accidental, the DA and Khloe’s first lawyer struck a plea deal. Khloe pleads guilty to vehicular manslaughter. She loses her license and gets 2 years probation. Everyone was onboard with this except the magistrate, Judge Harold Salinger. Nobody knew this at the time, but one of the kids that got clipped and lived was the Judge’s nephew. He knew the two “boys” that died and was absolutely insulted by this slap on the wrist. He threw out the plea deal and tried to sentence her to 20 years to life before the attorneys even knew what was going on. Instead of going home that day, Khloe was sent to prison without bail pending trial.
That’s when my good friend Lisa called me. “Hey, I need you to look into Khloe Thompson’s case.” She didn’t ask me if I had time, if I wanted to, or how much it would cost. I knew that if she was interested, then something’s rotten in Denmark.
Let me backtrack real quick on my friend, Lisa Sanders-Jones. I met her years ago when she worked as an AUSA. Assistant United States Attorney. She was a prosecutor for the feds, and had a 99% conviction rate. But she’s also very political. Every 4-8 years, she quits her public sector job and takes work as a criminal defense attorney. She makes her big money representing scumbags and lives off of that when she’s not working for Uncle Sam. The only thing she loves more than correcting miscarriages of justice is her family, and that’s like a 1A 1B kind of thing. Khloe’s case came up during her money making time, so I asked her how much she was making. “Pro bono.” After asking her if I’d get paid for this job, she just replied with “I’ll owe you one.” I ask what her timeline is, and she says “Soon.” If she wasn’t one of my best friends and all the shit we’ve been through, I’d have told her to fuck off.
So, I decided to start with the basics of the case. It seemed pretty straightforward. Driver lost control of the vehicle, jumped the curb, panicked and drove into a building hitting a bunch of frat boys on the way. Sounds like a tragic accident, so why did Judge Salinger get just a stick up his ass? One of the boys in the hospital was his nephew, and he’s a former member of Alpha Khi Rho. Plus, he was also a legacy. So that judge shouldn’t have been anywhere near that case. Lisa damn near shit a brick when she heard that, but wasn’t surprised. She and I figured that something was up since he was normally level-headed. Remanding a 19-year-old whiteish girl with no priors to prison without bail is absolutely batshit.
But what happened next is why Lisa got involved. The judge pulled some strings and got the girl charged with both first and second degree murder, alleging that the accident was premeditated and intentional. I’ve been in this game for over 20 years, and I’ve never seen the DA’s office go that hard on a traffic accident. A first degree murder charge carries the possibility of the death penalty, and in this state a capital case requires a lawyer who has worked one before on both legal teams. Lisa’s worked dozens of them from both sides. She’s as qualified as anyone around.
We met for lunch soon after and she told me why she asked me to look into this. Khloe said they raped her, and she wasn’t the only girl. The whole thing was a bad case of ‘boys will be boys’ cranked up to 11. These guys would pick a girl or two each semester during pledge week and sweet talk them into hanging out. Usually an upperclassman would pick an underclasswoman and make her think she was special. The grooming would start subtly, a snide comment here or a grope there. Then they’d get the girl drunk and get her to expose herself and record it for fun and blackmail. The so-called boyfriend would groom her to think that it was normal for his buddy’s to be in the room when they’re fucking, then that it’s normal for them to touch her or even join in. Before the girls know it, their boyfriend is letting his brothers fuck her. Any girls that fight back get raped over and over until it’s normal. When the pledges get confirmed, one of their first benefits is fucking the girls. By the end of the semester, she’s getting pimped out to anyone in the house. Assuming she comes back to school the next semester, she’s traded around frat row like a cheap Pokemon card.
I asked a bunch of questions, the normal ones for any investigation. Any witnesses, evidence, people that can corroborate her story, anyone she went to, etc. What Lisa told me both broke my heart and pissed me off. Not only did she have a list of witnesses and a ton of names and places, she documented every time she went to the various authorities. Resident life office, her RA’s, Campus Police, Ombudsman, City Police, the school’s clinic, all of it. Every time she spoke to someone, she got the run-around. Her RA’s would tell her to talk to their bosses in Resident Life, but they said since it wasn’t in the dorms they couldn’t do shit but refer to the Greek Life people, but since she wasn’t in a sorority they ignored her. City Police said they couldn’t pursue the case without Campus Police giving the go-ahead, but Campus Police scared her off by threatening her with an underage drinking charge for admitting to partying at the Alpha Khi Rho house. Any time she’d get even a little bit of progress, some old man would shut it down with a whole ‘boys will be boys’ dismissal, as if gang rape is just another day on Frat Row. But the worst was when she tested positive for several STD’s. This pushed her over the edge and she tried killing herself over Christmas break. She spent the next month in a psychiatric hospital and dropped out of school.
According to Lisa, Khloe said she wasn’t thinking when she drove over to Frat Row that night. She went out for a drive to clear her head when she ended up near there. Her ex Zac texted her, telling her to come over. Apparently he hid a tracking app on her phone and once she was within range he and his brothers spammed her. She said she went over to confront him, but blacked out when she saw him drinking and having fun in the front yard. ‘My life is ruined and he’s standing there laughing his ass off while his bros are gonna go on to have a great life.’ Next thing she remembers was waking up in the hospital with a busted nose from the airbag.
First thing I did was reach out to the original ADA. I know it sounds crazy, but I have some pretty tight connections in the office. The original plea deal was pretty generous considering 5 guys died, but the original ADA knew how pervasive the whole ‘boys will be boys’ culture was and had tried taking down Alpha Khi Rho aka the Crows for years. He knew that if this case went to trial, any halfway decent lawyer would bring this up and all it would take is one woman or parent on the jury to hang the jury. But once Judge Salinger killed the deal, he wanted nothing to do with the case. Not like he had a choice with it, he was removed and replaced with a legacy Crow who’s going for blood. Their case hinges on scaring Khloe into accepting a plea deal, which she refuses to do. The best they’re now offering is 20-25 years, which is absolutely insane for any cases like this. Their argument is about how many lives she ruined, blah blah blah.
After talking to the DA, I followed up on Khloe’s paper trail. Fucking depressing. Each and every time she reached out for help, she was rebuffed or led on a wild goose chase. The worst of these were the Greek Life department and Campus Police. I’ve never liked campus police. They exist solely to bury crime reports so mommy and daddy feel safe sending their kids to a glorified party school. Those groups stonewalled me and refused to give any info without a subpoena, so that was Lisa’s next steps.
I had an easier time getting my hands on copies of the victim’s phones than I did getting Campus Police to pull up records of Khloe’s previous reports. That was eye opening. The ex Zac had a plethora of videos of girls on his phone, including several of Khloe. What is it with this generation of kids filming their felonies? Sure, it makes my job easier, but what the fuck, bro? It also wasn’t hard to track down his coconspirators via his contacts and messaging apps.
That dumbass had a dozen girls all with the same contact company of Fuckmeat. One of them was Khloe. I reached out to these girls. None of them wanted to talk at first, but I eventually got through to three of them. Their stories lined up almost perfectly with what Khloe went through, and one of them named Kaycie even had video of a gangrape they sent her to keep her quiet. I was flabbergasted at the audacity of it. When I asked her if she went to the cops, she said “Why bother? The charges just get wiped away anyway.” The last couple girls that complained all got expelled and charged with various crimes while the Crows kept getting away with it because of friends in high places. Kaycie even invited me to a secret group chat she had with some of the other victims. They’ve tried to move on, but they were pretty pissed off with what happened. I was able to direct them to another police department that had jurisdiction over the area to file reports against the Crows.
I gave all of this info to Lisa and let her take point on the matter. I knew that no matter how good of an investigation I might have, her murder case was top priority. What she laid out was a masterpiece of courtroom drama worthy of the best Perry Mason could ever deliver.
Her first step was calling for a change of judge and/or venue as soon as the case began due to Salinger’s ties to the victims. He declined to recuse himself, so her next step to file for a mistrial on grounds that the court was already biased against her client based on familial connections. She put this out there even before the opening statements.
Next while the prosecution painted Khloe as a heartless monster that targeted these poor, innocent men, Lisa went on the warpath. The prosecution called the brothers one by one to relay what happened during the attack, just to have Lisa tear them apart when she made them read the disgusting and vile messages they sent to Khloe. Watching a frat bro in a wheelchair be forced to read a text about how he was going to rape Khloe’s ass then make her suck the shit off his cock really served as a counterpoint to his tears. 15 different Crows each took the stand, and by the time they were done they’d each basically confessed to multiple counts of rape. 5 of them were smart enough to decline taking the stand after seeing what happened to their brothers. The prosecutor’s plan was shot to shit. Any attempts at building sympathy for the victims disappeared with their own texts. But Lisa did something brilliant. She had each of the Crows identify at least one or two of their brothers, including themselves, from dimly lit and grainy pics. They looked like they were zoomed in from screenshots of videos. I questioned where she was going with this, but one thing I know about Lisa is she loves playcraft and is a fervent follower of Chekov’s Gun: if you introduce a gun in Act 1, you have to use it in Act 2.
Aside from the Crows, the prosecution didn’t have any other witnesses besides the first responders. They testified that Khloe was unconscious at the scene but her BAC and drug screens came back clean. Lisa didn’t go after them too hard, except for asking for their notes, and confirming who was on scene. Lisa wanted to know if the local police had secured copies of Khloe’s phone as well as those of the fraternity brothers. The police confirmed they did. She asked if they went through Khloe’s phone, and if they found any plans of her harming anyone other than herself. They confirmed that it was no. She then asked if the police had confirmed if any of the victims had texted her anything in the preceding minutes before the accident. They did, and they did. She asked the police if these messages met the bar for harassment and threats of sexual violence. The cops agreed to that. Finally, she wrapped it up by pointing out the cop’s own testimony that there was no sign of premeditation, no response to extremely offensive messages and a woman in an already fragile mental state, could it be that she simply was overcome by the stress and blacked out? Even the cops had to admit that Lisa had a point. The prosecution rested their case.
Now it was Lisa’s time to cook, and cook she did. She started with entering into evidence videos of the gangrapes that Zac filmed on his phone, and tied each of the men identified in the previous pictures to the videos. The best trick was when she zoomed out from each face to show them in various sexual acts with Khloe. Lisa played the video of the first gangrape where it was obvious that Khloe was fighting back and screaming no the whole time. 5 of the 7 dead Crows took part in the first video. Judge Salinger cut the video short after 5 minutes and several objections from the prosecution and admonished Lisa for playing the video in his courtroom. She pivoted to calling a new witness, Tyler. Tyler was a pledge who took part in some of the gangrapes who flipped after a visit from a detective scared the shit out of him. He identified everyone in the video via stills, including himself. The judge lost his shit when Lisa asked “Can you identify the Judge’s nephew in this photo?” But she was just starting to show the hell that Khloe went through. Next up was her doctor who confirmed her positive STD tests, signs of extreme sexual trauma, and her suicide attempts. The doctor described in detail how what she went through could easily cause stress-related blackouts, especially if triggered by what caused her PTSD. Lisa then called Khloe’s RA and the Resident Life Director and asked about Khloe coming to them about what she went through. They testified that they tried to help, but couldn’t. The red tape stopped them from making any difference. Lisa asked the Director if they ever had other young women report issues with Crows. They said yes, and Lisa asked if any of a list of names were those women. Lisa listed out the other Fuckmeat contacts in Zac’s phone and the Director recognized a couple of them. Lisa then told the court that those other women went through the same abuse that her client did, and that they were willing to testify to that if needed. The prosecution objected to that statement and told Lisa to keep the case about Khloe, not the Crows. Lisa did call two of the other women, including Kaycie. Young Kaycie described the hell the Crows put her through and how she tried to report it, but all that came of it was getting threatened by Campus Police. The prosecutor thought he had a great gotcha moment and asked her “If you went through what the defendant did, why didn’t you try to kill them?” He wasn’t expecting her to say “I wanted to. I tried. But my Dad stopped me from taking his gun to school. No one gave a shit about what they did. I’m just mad that she killed them before I could.”
The prosecutor tried a last minute plea deal of a 3 year sentence for voluntary vehicular manslaughter, but it was pretty apparent by this point that he’d lost the case. His closing statement was based on the facts, but his heart was no longer in it. Lisa on the other hand nailed a corrupt system to the wall that ruined a young woman’s life, left her for dead, and put her through Hell. By the time she was done, several members of jury were in tears.
It took the jury about an hour to come back with a Not Guilty verdict. Lisa planted enough doubt about Khloe’s mental well being that she might not have been in control of her faculties at the time of the accident, and showed enough that even if she was, what she did was not premeditated murder. Khloe’s actions also didn’t meet the bar for second or even third degree murder, either. Seeing how relieved Khloe was made this old cynic feel good for a moment.
Almost as good as seeing this case drag Crows out into the sun. Tyler flipped like a monkey on his brothers as the rest were taking down. We spent a long time putting a lot of bad guys in jail. And we didn’t stop at just the brothers. We found enough dirt to go after many in the school’s administration including the Dean and most of his staff. After the trial, the floodgates opened and dozens of victims came forward going back damn near 50 years.
I waited a couple years to ask Lisa what really happened with Khloe that night. I had a feeling that Khloe didn’t black out. Lisa wouldn’t tell me straight one way or another, but I knew her well enough that she did what she needed to do to get her client off. If that meant destroying those that hurt her client, so be it.
The Crows benefited for years from everyone turning a blind eye where a ‘boys will be boys’ mentality until one night one of their victims got a little revenge. The system that protected them was dismantled from the inside, and all this started because a young woman got away with murder.
